Terms of Use

The main agreement for FitFourby accounts, the web platform, Garage, comparisons, planning tools and submitted content. The platform licence is included here. Contextual terms apply only to the relevant service.

1. Who we are and when these Terms apply

FitFourby is an Australian vehicle and aftermarket research, comparison and planning service operated by FITFOURBY PTY LTD, ACN 703 106 665, ABN 39 703 106 665, a proprietary company limited by shares registered in Western Australia on 9 October 2026 (FitFourby, we, us). Contact hello@fitfourby.com.au for service, legal, copyright, corrections or privacy matters.

These Terms explain the conditions on which we offer the website, accounts, My Garage, comparisons, calculators, guides and reports. When you create an account or expressly accept these Terms at another identified action, they form part of that arrangement. Public information remains available to browse without creating an account. We do not rely only on a footer link or passive browsing as proof that you accepted an account or paid-service contract.

Paid membership, individually priced digital reports and other future features apply only when actually offered, clearly described and separately chosen. A free account or enquiry does not enrol you in a paid service.

Company transition, 9 October 2026. These Terms identify the company for new arrangements from this date. Earlier contracts, issued documents and acceptance records retain the operator and terms recorded when they were made. This update does not by itself transfer an earlier contract, liability, asset or content permission to the company. Any transfer requiring agreement will be addressed separately.

2. Which documents apply

The platform licence, acceptable use, user-content and paid-report provisions below are part of these Terms. The Privacy Policy explains information handling; acknowledging it is not a waiver of privacy rights or consent to every possible use.

  • Advisory Terms apply when your accepted written proposal identifies them. For that engagement, expressly agreed scope, deliverables, price, payment and delivery particulars in the proposal prevail over inconsistent Advisory Terms, which prevail over these Terms for advisory matters.
  • Fitter and Business Listing Terms apply when an authorised business representative submits or manages a listing with clear acceptance. They prevail for listing matters.
  • Membership Terms apply only to an expressly purchased membership after activation and prevail for membership matters. The recorded checkout particulars specify your selected plan and price.

Only documents identified to you before acceptance form part of the relevant contract. A link to an article, policy or third-party site does not by itself incorporate it. No document or priority rule overrides a right or liability that cannot lawfully be excluded. We retain the versions relevant to your acceptance; a later website edit does not silently rewrite an earlier engagement.

3. Accounts, age and authority

You must be 18 or older to hold your own FitFourby account, purchase a service or enter a business-listing agreement. This is our launch policy for contractual capacity and responsibility, not a statement that Australian law forbids minors from browsing or making every type of contract. Younger people may browse the public information and research with a parent or guardian who holds any account and enters any service arrangement in their own name.

Provide accurate account details, keep your sign-in credentials and recovery methods secure, and tell us promptly if you suspect unauthorised access. Do not share an account in a way that exposes another person's information. We remain responsible for our own security obligations; this clause does not make you automatically liable for every action taken through a compromised account.

If acting for a business, you must have authority to bind it for the particular arrangement and provide information on its behalf. Use an account for the purposes described at signup. We may ask for proportionate evidence if age, identity, security or authority is genuinely in doubt.

4. Platform and software licence

We grant you a non-exclusive, non-transferable permission to access and use the web platform for lawful personal research and internal business planning in accordance with these Terms and the features made available to you. You may download or print reports supplied to you and share relevant outputs with your own adviser, supplier, installer or team to assess your vehicle or build, retaining source dates, qualifications and notices. A report is not a licence to resell our service or republish the catalogue commercially.

FitFourby or its licensors retain rights in original software, writing, graphics, branding, reports and any protected original selection or arrangement of material. We do not claim ownership of manufacturer facts, third-party trademarks, photographs or documents merely because they appear in our research. Third-party material remains subject to its owner's rights and any stated licence.

Without our written permission, do not mirror the platform, sell access, systematically extract or republish substantial parts of protected content, or use automated access that bypasses controls or materially burdens the service. Ordinary authorised search indexing and accessibility tools are not prohibited merely because they are automated. Do not remove attribution or present altered results as FitFourby's unaltered work.

No restriction in these Terms removes a statutory exception or other right that cannot lawfully be excluded, including applicable computer-program rights under the Copyright Act 1968. There is no separate web-platform EULA to accept. A future native or separately downloadable application may have a specific licence disclosed before its use.

5. Technical information and planning tools

We take reasonable care in researching and presenting information, keeping its sources and qualifications visible and correcting identified errors. Coverage is limited to the vehicles, variants and products researched. A missing entry is not proof that no suitable option exists; catalogue presence does not establish exact fitment, stock or approval.

Specifications can vary by model year, market, engine, transmission, body, trim, production change, equipment and modification history. Manufacturer material and third-party prices may change or conflict. Check the exact vehicle and product, the source date, included components, units and any unknown or approximate values. Prices are research guides on the basis displayed, not offers by the supplier.

Calculators use the stated model, available data and your inputs. They are estimates for planning, not measurements of your vehicle or a guarantee of safety or compliance. Unknown values are not zero. Confirm actual loaded vehicle and axle masses on suitable scales, include all occupants, fluids, cargo, accessories and towing loads as applicable, and use the ratings that lawfully apply to your vehicle. Do not treat spare capacity under one rating as permission to exceed another.

Before a safety-sensitive purchase, modification, loading or towing decision, confirm fitment and limits with the responsible manufacturer, installer, engineer or vehicle authority as appropriate. Modification and registration requirements can differ between States and Territories. FitFourby does not issue engineering certification, roadworthiness approval, insurance cover or legal advice. Important model-specific limits are also shown with the relevant tool. These qualifications do not remove our responsibility for our own representations or agreed paid work.

6. Garage, saved work and report outputs

My Garage lets you organise vehicle and build information. Browser-stored work depends on that browser and can be lost if its data is cleared or the device changes. Account saving operates only where the signed-in feature confirms it. Importing a browser build is a separate action; do not assume every local copy has automatically synchronised.

Check that a save or export completed and retain a copy of important planning work. This practical step does not transfer our service obligations to you. We will explain material changes to storage or access and provide a reasonable opportunity to retrieve work where practical before planned withdrawal of a feature.

A generated PDF records the inputs, available sources and calculation basis at generation. Later source changes do not automatically update a downloaded copy. A saved build or report is not evidence that a vehicle has been weighed, inspected, certified or approved.

Upload information or documents only through a feature or protected channel actually offered. Provide only material needed for the purpose and remove unnecessary registration, VIN, address, financial or other personal details where possible. Private account content is handled to provide the service, not licensed for public promotion under the public-content provisions below.

7. Manufacturers, suppliers, fitters and commercial relationships

Unless we expressly agree otherwise for a particular transaction, FitFourby is not the manufacturer, retailer, installer or contracting agent for a listed product or fitter. Third parties set their own quotes, availability, terms, warranties and workmanship obligations. A listing or link does not create a product warranty from FitFourby. Confirm current fitment, qualifications, insurance, authorisations and the scope of work directly before engaging a business.

Directory information and any verification label mean only the checks and date described. Installer status and authorised-dealer status are different. We remain responsible for statements we make and work we agree to perform; identifying an independent supplier does not excuse our own misleading representation or failure.

Recommendations follow the stated needs and available evidence. We disclose a relevant material financial or commercial interest beside the recommendation or placement before it could influence your decision. Future advertising, affiliate links, referral fees, supplied products or paid visibility require appropriate disclosure. Commercial support must not silently change technical specifications or buy a favourable technical conclusion. No future commercial arrangement is activated merely by this clause.

9. Advisory enquiries and engagements

Sending an enquiry requests a response and does not book a timeslot, create a paid engagement or authorise payment. Advisory work begins only after the scope, price, delivery arrangements, necessary information and applicable terms are agreed, and any agreed deposit is received.

Your versioned proposal and the Advisory Terms govern the engagement. Advice is tailored to the vehicle, intended use and question recorded there. A supplier's refusal to discount is not itself a failure to perform a properly agreed quote-research task; this does not limit remedies if we fail to perform that task with the required care and skill.

10. Your content and public submissions

You retain ownership of material you submit. You must have the rights and authority needed to share it and must not submit unlawful, misleading or infringing material or unnecessary personal information about someone else. For private Garage information and service documents, you authorise us only to host, process, back up and use the material as reasonably needed to provide and protect the requested service, subject to the Privacy Policy.

For content you expressly submit for public publication, you grant a non-exclusive, royalty-free licence to host, reproduce, resize, format and display the approved content through FitFourby and to use service providers for those purposes. We may make presentation edits that do not materially misrepresent it. Attribution and the publication scope will be agreed with you. We will obtain your written approval of a Gallery feature's draft before publication.

Using your identifiable content in a separate advertisement, testimonial or case study requires the relevant separate permission; sending a private enquiry or uploading a weighbridge ticket does not grant it. Where agreed promotional use is part of your public submission, that use is limited to the content and channels explained to you.

You may request removal or withdraw future public-use permission by contacting us. We will stop new use and remove material from channels we control within a reasonable time, subject to lawful retention and legitimate record keeping. Copies already distributed, independently shared or cached by others may not be recoverable; we will explain any practical limitation. We do not claim ownership of your content or an unrestricted perpetual licence.

We may decline or remove content for accuracy, privacy, intellectual-property, safety, legality or relevant editorial reasons. Where reasonable we will explain the reason and allow you to correct it; urgent removal may be necessary first. We are not obliged to publish a submission. Report a copyright concern with the affected URL, the work concerned, your authority and contact details so we can investigate fairly.

11. Acceptable use

Use FitFourby lawfully and respectfully. Do not attempt unauthorised access; interfere with security or availability; upload malicious code; impersonate another person or business; submit false measurements or fabricated evidence as verified facts; harass others; publish unlawful material; or use enquiry details for unrelated marketing without a lawful basis.

Do not bypass access or payment controls, misrepresent a planning estimate as certification, or remove qualifications to mislead someone about a report. These rules do not prevent lawful criticism, reporting a concern, ordinary research or activity protected by non-excludable law. Tell us privately about a suspected security issue using our contact address and avoid accessing or disclosing other people's information.

12. Availability, changes and account restrictions

We maintain the platform with reasonable care, but maintenance, failures and circumstances outside our reasonable control can interrupt access. We will take reasonable steps to restore affected services and communicate material interruptions where practical. We do not promise uninterrupted access or permanent availability of every free feature.

We may restrict an account or specific activity where reasonably necessary to address a material breach, credible security threat, unlawful conduct or risk to another person. Our response will be proportionate. Except where urgent action, law or security makes it inappropriate, we will give a reason, notice and a reasonable opportunity to respond or fix the issue. You may ask us to review a decision.

We may end an account after an unresolved material breach or where lawful operation is no longer practicable. Where practical and lawful we will allow retrieval of your own work. Termination does not automatically forfeit prepaid fees or remove accrued rights; any affected paid service and refund are handled under its applicable terms and consumer law. You may stop using the service and request account closure through the contact or account controls provided. Privacy retention and deletion are addressed in the Privacy Policy.

13. Consumer rights, corrections and remedies

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right, remedy or liability under the Australian Consumer Law or another law that cannot lawfully be excluded. Our services must meet applicable guarantees, including due care and skill, applicable fitness-for-purpose guarantees and supply within a reasonable time where no time is fixed. Applicable guarantees also protect qualifying digital goods.

If a service or output fails to meet a guarantee, the remedy depends on the circumstances. It may include correction within a reasonable time, cancellation, a refund for unconsumed services, replacement or compensation, including reasonably foreseeable loss where the law provides it. You are not required to accept account credit instead of a refund you are legally entitled to receive.

Contact us with the relevant account, order or engagement reference and a description of the issue. We will investigate and explain the proposed remedy. A revision allowance, short reporting request, cancellation policy or the fact that you downloaded a report does not cut down these rights. We do not impose a contractual deadline that extinguishes a statutory claim.

14. Responsibility and proportionate limits

Each party remains responsible for the consequences of its own acts and omissions as the law provides. We are not responsible for a loss caused solely by an independent third party's act, an inaccurate input we could not reasonably identify, or a use outside the agreed purpose, except to the extent we caused or contributed to the loss or a non-excludable obligation makes us responsible. Reasonable verification steps stated with a tool help identify its intended use; they do not excuse our own lack of reasonable care.

For use in a business, and only where the law permits, we do not assume responsibility for lost commercial profit, business interruption or lost business opportunity outside the purpose and risks expressly agreed for the service. This does not exclude a loss that a non-excludable law requires us to compensate. We do not apply a blanket zero-dollar cap to free users or a blanket cap equal to a report price to all consumer claims.

Any different liability allocation for a separately negotiated commercial engagement must be specifically identified and agreed in its proposal and lawful in the circumstances. Nothing here excludes liability for our fraud, wilful misconduct or any liability that cannot lawfully be limited. There is no general consumer obligation to indemnify us against all claims.

15. Changes to these Terms and records

Each version has an identifier and date. We keep historical versions internally so an acceptance record can be matched to the document presented. Minor editorial corrections that do not change contractual rights do not ordinarily require another acceptance action.

Before a material contractual change affects an existing account or paid arrangement, we will explain the change, its proposed timing and your relevant options in reasonable advance. Where fresh agreement is appropriate, we will request an affirmative action. We will not retrospectively remove an accrued right or treat a website edit as agreement to new charges. If a material change adversely affects a paid service, applicable cancellation and refund rights will be available as described in its terms and by law.

Privacy Policy updates are handled as privacy notices, with separate consent sought where the particular processing requires it. They are not automatically treated as amendments to a contractual privacy waiver.

16. Contact, disputes and governing law

Please contact hello@fitfourby.com.au first with a complaint so we can try to resolve it promptly. We aim to acknowledge a substantive complaint within five business days and explain the investigation and next steps. You remain free to approach a regulator, seek urgent relief or exercise a statutory right without completing an exclusive internal process.

These Terms are governed by the laws of Western Australia, Australia. The parties submit to the non-exclusive jurisdiction of its courts and courts hearing appeals from them, subject to any mandatory right to bring a claim elsewhere. This choice does not displace Australian Consumer Law or other mandatory protections.

If a provision cannot be enforced, the remaining provisions continue to the extent they can sensibly operate. A delay in enforcing a right does not by itself waive it. FitFourby is initially directed to Australian vehicles and users; overseas access does not expand the represented geographic coverage of our data or advice.
