Fitter and Business Listing Terms

Contextual terms for an authorised business representative submitting or managing a FitFourby directory listing. They do not make every independently researched directory business a contracting user.

1. Scope and acceptance

FitFourby is operated by FITFOURBY PTY LTD, ACN 703 106 665, ABN 39 703 106 665.

These Terms apply between the FitFourby operator identified in the Terms of Use and the business for which you are authorised to submit or manage listing information. The submission action must clearly identify that you agree to these Listing Terms before you send it. The general platform licence, acceptable-use, consumer-rights and dispute provisions of the Terms of Use also apply. These Listing Terms prevail for listing matters, subject always to non-excludable law. The Privacy Policy explains how personal information is handled.

A business appearing in an independently researched or unclaimed directory entry has not agreed to a contract merely by being listed. It can request a correction or raise a concern without accepting a paid arrangement. Submitting a listing does not enrol the business in consumer membership or a paid lead service.

Company transition, 9 October 2026. These Terms identify the company for new arrangements from this date. Earlier contracts, issued documents and acceptance records retain the operator and terms recorded when they were made. This update does not by itself transfer an earlier contract, liability, asset or content permission to the company. Any transfer requiring agreement will be addressed separately.

2. Authority and accurate information

You must be 18 or older and authorised to act for the business. Supply accurate business and branch names, locations, service areas, contact details, services and any claimed qualifications, insurance, manufacturer authorisations or specialist capabilities. Do not claim an authorisation for a different branch, expired period or unrelated work.

Tell us promptly when a material detail changes or an authorisation ends. Provide reasonable supporting evidence if we need to check a claim. Share public-facing contact details you are authorised to publish and avoid unnecessary private employee information.

You retain rights in material you supply. You grant us a non-exclusive, royalty-free licence to reproduce, format and display the approved listing details, logo and relevant images for the directory and communications about that listing. We will not materially distort your branding or imply an endorsement beyond the actual relationship. You confirm you have the required rights and permissions.

3. Checks, publication and ranking

We may review a submission, request clarification, correct formatting or decline unsupported or unsuitable claims. Submission does not guarantee publication, a particular ranking, exclusive territory, traffic, enquiries or sales. Any verification description means only the checks and date explained; it is not a guarantee of every aspect of a business's work.

Installer status and authorised-dealer status are distinct. Customers should confirm current scope and authorisation directly. Standard directory listings and referrals are free at launch. After user filters, current directory results are grouped by State and ordered by postcode. If the method changes materially, we will explain the relevant basis.

A future paid listing, sponsorship, lead service or commercial placement requires a separate, clearly priced offer and affirmative agreement. Paid influence on visibility must be identified to users. It must not silently alter technical facts or the outcome of an independent recommendation. These Terms do not grant us authority to charge for an existing free listing.

4. Enquiries and customer relationships

We may pass an enquiry to the business only as explained to the person making it. Use the details to respond to that enquiry and provide the service requested. Do not sell the lead, add it to unrelated marketing lists or disclose it more widely without an appropriate lawful basis. Apply reasonable security, limit staff access and remove information when it is no longer required, subject to legal record keeping.

An enquiry is not a confirmed booking or guaranteed customer. You are responsible for your own quotations, pricing, appointments, licences, warranties, installations and workmanship. Make your identity and terms clear to the customer before they engage you. FitFourby does not accept quotations, place orders or bind either party unless a separate express written authority says otherwise.

Tell us promptly about a misdirected enquiry or suspected privacy/security incident involving information supplied through FitFourby so we can help contain it. Do not send sensitive customer documents back through an unsuitable public channel.

5. Fair conduct and commercial disclosures

Do not fabricate reviews, qualifications or customer experiences; submit misleading comparisons; impersonate another business; pressure a customer to remove a truthful review; or suggest FitFourby has certified your work when it has not. You may challenge an error and provide evidence for review.

Disclose a relevant commercial relationship or benefit connected with a submission or recommendation. We will identify a paid placement or referral relationship appropriately before it could affect a user's decision. Any actual commercial terms must separately specify fees, tax, duration, deliverables, cancellation and data use.

6. Corrections, removal and ending participation

Contact hello@fitfourby.com.au to correct a listing, end management of it or request removal of material you supplied. We will verify authority proportionately and act within a reasonable time. Ending your participation does not require us to erase every accurate public fact from an independently researched directory, but we will consider privacy, safety, legal and accuracy grounds fairly and explain the outcome.

We may pause or remove a listing where reasonably necessary because it is materially inaccurate, unlawful, misleading, unsafe, outside the directory's scope or linked to a serious breach. Where practical we will give the reason and an opportunity to respond or correct the issue. Urgent risks can require removal first. You may ask us to reconsider with supporting evidence.

We may discontinue the free directory or a free listing feature on reasonable notice where practical. Any paid arrangement must have its own fair cancellation and unused-fee treatment; this clause does not forfeit prepaid fees or remove accrued rights.

7. Responsibility, remedies and disputes

Each party is responsible for its own statements, conduct and obligations. You are responsible for having authority and rights to material you supply; we remain responsible for our own representations, information handling and promised services. Neither a listing disclaimer nor a directory label transfers every risk to the customer or business.

Non-excludable consumer and small-business protections remain available, including applicable consumer guarantees and unfair-contract-term rules. The proportionate responsibility and dispute provisions of the Terms of Use apply. There is no blanket indemnity for all claims or automatic zero-dollar liability cap in these Listing Terms. Any additional allocation for a future paid commercial service requires express, lawful agreement.

Material changes affecting a current contractual listing arrangement will be notified reasonably in advance, with an opportunity to end participation and any required remedy. A historical independently researched listing is not evidence of acceptance of new terms. The accepted document version and affirmative submission context will be retained as described in the Terms of Use.
