Advisory Services Terms

Terms for a separately scoped vehicle, modification, build or fleet research engagement, incorporated by the accepted written proposal. An enquiry alone creates no paid commitment.

1. Your engagement and document order

FitFourby is operated by FITFOURBY PTY LTD, ACN 703 106 665, ABN 39 703 106 665.

These Terms apply to advisory work by the FitFourby operator identified in the Terms of Use when a written proposal identifies this version and you expressly accept it. The proposal must record the client, vehicle or fleet scope, research question, intended use, deliverables, exclusions, assumptions, fee, applicable tax, payment stages, delivery arrangements and revision allowance. We confirm acceptance and start requirements in writing.

The expressly agreed engagement-specific scope, deliverables, price, payment and delivery particulars in your accepted proposal prevail over an inconsistency in these Advisory Terms. These Advisory Terms then prevail over the Terms of Use for advisory matters. A later invoice or website edit does not silently add conditions to the engagement. No priority rule or agreed scope removes a non-excludable right. The Privacy Policy is an information-handling notice, not a waiver.

An enquiry does not book a timeslot or authorise payment. Additional work, including a different vehicle, question or materially expanded purpose, requires a written scope and fee change before that work begins. We will identify what is new work and what is a correction of our original work.

Company transition, 9 October 2026. These Terms identify the company for new arrangements from this date. Earlier contracts, issued documents and acceptance records retain the operator and terms recorded when they were made. This update does not by itself transfer an earlier contract, liability, asset or content permission to the company. Any transfer requiring agreement will be addressed separately.

2. What the service provides

We research and explain options for the vehicle, information and intended use recorded in your proposal. We will use due care and skill, identify the evidence and assumptions supporting our recommendation, and distinguish known figures, estimates and missing information. The deliverable is the written answer, comparison, plan or other output expressly agreed; a package name does not expand its scope indefinitely.

Advice can address relevant effects on mass, payload, axle or roof loading, geometry, handling, braking, gearing, towing, compliance, reliability and dependencies to the extent agreed and supported by evidence. We will identify where an installer, manufacturer, engineer, insurer or authority needs to confirm a matter. We may conclude that no purchase or modification is appropriate.

We do not supply or install parts, physically inspect or weigh a vehicle, provide engineering or roadworthiness certification, approve a mine-site or fleet standard, arrange insurance or provide legal advice unless a separate expressly described service lawfully says otherwise. A researched compliance pathway is not an approval. For fleet and mine-spec work, the proposal must distinguish research requirements from approvals reserved to the client, site operator or authorised professional.

3. Information and decisions

Give us the accurate vehicle identity, configuration, current modifications, intended use, relevant loads and measurements, budget and documents reasonably needed for the agreed question. Tell us about a material change during the engagement. We will explain why additional information is needed and flag gaps or inconsistencies we reasonably identify.

We may need to pause an affected part of the work where missing information would make a recommendation unreliable. We will explain the consequence and agree a practical next step or revised schedule. We will not knowingly present a guess as a verified figure. You are not expected to detect an error that our reasonable care should identify.

You decide whether to buy a product, accept a supplier quote or arrange installation after considering the report's stated checks. Confirm current specifications, exact fitment, actual masses, approvals and insurer requirements with the responsible party before proceeding. These steps do not remove our obligations for the quality or purpose of our own advice.

4. Fees, deposits and payment

We confirm scope, price and timing in writing before work starts. No payment is taken with an enquiry. Unless a different written arrangement is expressly agreed, work of $300 or less is invoiced with the answer or report. Work over $300 requires a 50% deposit; you receive a summary before the balance is due within seven days, then the full report follows payment. Lower-value invoices are also due within seven days unless the accepted proposal states another period.

The accepted quote states the total payable in AUD, tax treatment, any authorised expenses and each payment milestone. A starting price or day-rate range is not the final fee; scoped engagements identify the agreed total or a clear calculation and limit before acceptance. We do not add unapproved expenses or increase the fee merely because a supplier quote or potential saving changes.

If you dispute an invoice in good faith, tell us what is disputed promptly. We will investigate and discuss resolution; undisputed sums remain payable under the agreed schedule. We may pause undelivered work for overdue undisputed amounts after reasonable notice and an opportunity to resolve the issue. We will not withhold a remedy or information you are legally entitled to receive, and do not impose an undisclosed penalty.

5. Timing and delays

The proposal records the delivery milestone and whether a date is an estimate or an expressly agreed essential deadline. Target turnaround ordinarily starts once the scope is accepted and required information and any agreed deposit are received. We identify known supplier dependencies.

We will work to the agreed schedule and notify you promptly if a material delay becomes likely, explaining the reason and revised timing. If we cannot meet an essential agreed date, or a material delay defeats the agreed purpose, you may cancel the affected unperformed work and receive the appropriate refund and any other remedy required by law. If no time has been fixed, applicable reasonable-time obligations remain. A missed date is not automatically excused merely because a document labels timing an estimate.

6. Research, quotations and third parties

Reports identify the relevant research basis and date. Specifications, prices, availability and supplier terms can change; a report records the position investigated at that time. We do not provide ongoing updates unless included in the scope. If we discover a material error in our delivered work, we will take reasonable steps to tell the affected client and correct it.

If quote research is included, we will perform the agreed enquiries with reasonable care. We cannot guarantee a supplier response, stock, discount or a particular price. Unless expressly authorised in a separate arrangement, we are not your contracting agent: we cannot accept a quote, place an order, book work or bind you or the supplier. A binding product or installation agreement is made directly with that business.

Under our current advisory arrangement, negotiated savings are yours and do not increase our agreed fee. We disclose any material commercial interest relevant to a recommendation before you decide. Commercial support cannot buy a favourable technical conclusion. A supplier declining a discount is not itself a service failure where we performed the promised work; you retain remedies if we did not.

7. Corrections, clarification and revisions

The proposal records the included revision allowance. Unless it provides a more generous allowance, tell us within 14 days of delivery if the report has not addressed the question within the agreed scope, and we will make an appropriate in-scope revision without an additional fee. Ask promptly if a point is unclear.

This 14-day service allowance is not a limitation period for factual errors, consumer guarantees or other legal rights. We will assess a claim outside that window on its merits and provide any legally required remedy. A new vehicle, substantially different budget or new question may be separately quoted, but fixing our failure to perform the original engagement is not automatically new paid work.

8. Cancellation and refunds

You may ask to cancel before or during the engagement. If work has not started and no separately approved unavoidable cost has been incurred, we will refund payments for that work. For a change-of-mind cancellation after work starts, we may retain a reasonable amount for work actually performed and separately approved, unavoidable costs, up to the agreed fee; we will explain the calculation and refund the remaining advance. A deposit is not automatically non-refundable.

We will take reasonable steps to avoid unnecessary costs after cancellation. We will provide completed paid-for work in a usable form where appropriate, clearly identifying if it is incomplete and unsafe to rely on as a finished recommendation. We will not demand the whole remaining fee solely because you cancelled.

If we end an engagement because we cannot provide the agreed service, we will explain the reason and refund amounts for unperformed work. Different or greater remedies may be required if we are at fault or a consumer guarantee fails. The change-of-mind provisions do not reduce your rights for a major failure, misleading description, lack of due care or other breach.

9. Deliverable use and intellectual property

You may use the supplied report for the personal or internal business purpose stated in the proposal and share it with the suppliers, installers, advisers, staff or site personnel reasonably involved in that purpose. Keep the relevant assumptions, dates, source references and limitations with it. Do not present an edited extract as an unaltered FitFourby recommendation or resell the report as your own advice service without permission.

You keep ownership of your supplied information and materials. FitFourby and its licensors retain rights in their original work and tools. Manufacturer facts, trademarks and source documents are not claimed as FitFourby property. The report does not transfer rights in a third-party brochure or image beyond any lawful permission that already applies.

Private client information is used for the agreed service and handled under the Privacy Policy. Public case studies, testimonials or identifiable promotional use require separate optional permission and any agreed draft approval. Declining those permissions does not affect the service. Identifiable client information must not be sent to a third-party AI service without appropriate disclosure, authority and safeguards.

10. Rights, responsibility and disputes

Nothing in this engagement excludes, restricts or modifies a guarantee, right, remedy or liability that cannot lawfully be excluded. Applicable consumer guarantees include due care and skill, relevant fitness-for-purpose obligations and reasonable-time obligations. Remedies can include correction, cancellation, an appropriate refund and reasonably foreseeable loss where the law provides it. The fact that a client is a business does not by itself remove consumer or small-business protections.

The responsibility provisions of the Terms of Use apply. We do not disclaim all responsibility for your reliance on an agreed recommendation, and no blanket fee-only cap or exclusion of all consequential loss is imposed on consumer claims by these Advisory Terms. Any specifically negotiated commercial risk allocation must be expressly identified, fair and lawful; it cannot override non-excludable rights.

Raise a concern with hello@fitfourby.com.au using the engagement reference so we can investigate. The complaint and non-exclusive Western Australian jurisdiction provisions of the Terms of Use apply without preventing access to a regulator, mandatory consumer forum or urgent relief.

11. Acceptance record and later changes

The proposal should identify its reference and issued version, the Terms of Use version and these Advisory Terms' version, with the documents available before acceptance. Acceptance may be an explicit reply from the authorised client identifying that proposal and agreeing to its scope, fee, payment schedule and incorporated terms, or another clearly recorded affirmative method.

We retain the issued proposal and relevant terms with the acceptance date and method. A staff note that someone accepted does not replace the underlying acceptance communication where available. Changes affecting the agreed scope, price or material conditions require recorded agreement; an invoice, revised website page or silence does not by itself establish acceptance of new work or charges.
