In this document
1. When these Terms apply
FitFourby is operated by FITFOURBY PTY LTD, ACN 703 106 665, ABN 39 703 106 665.
Membership is not activated by publishing this page. These Terms apply only if FitFourby actually offers a paid membership and you choose it through an approved purchase flow. Your contract is with the operator identified in the Terms of Use, which also apply. These Membership Terms prevail for membership-specific matters, while the recorded purchase particulars define your selected plan, inclusions and price. Mandatory consumer rights prevail over all documents. The Privacy Policy explains information handling.
A free account, early-interest registration or use of a free feature does not create a paid subscription. No trial converts into a paid plan unless the conversion was clearly disclosed and affirmatively chosen before it began.
2. Information before you subscribe
Before the purchase action we will show the plan's material benefits and limits; total payable in AUD including applicable tax and unavoidable charges; billing frequency; initial and renewal periods; whether renewal is automatic; any minimum term; cancellation method and effective time; and any introductory period and subsequent price. A monthly instalment amount will not hide a longer minimum commitment.
The action will clearly identify that it starts a paid subscription. Direct links to these Terms and the Terms of Use will be available beside it, with a Privacy Policy acknowledgement. You will not need to accept separate marketing permission to subscribe. We will send a confirmation of the chosen particulars and applicable agreement versions.
Only the benefits stated in the accepted offer are included. Personal advice, individual reports or future features are not included merely because the platform discusses them. We will describe essential technical or account requirements before purchase.
3. Payment and renewal
Payment is due at the times shown in your accepted offer through the payment method you authorise. A plan renews automatically only if you expressly choose the disclosed recurring arrangement. Renewal continues at the disclosed interval until cancelled.
We will send a reminder before each automatic renewal, stating the next charge, renewal date and direct cancellation route. If the promised reminder is not sent, we will not rely on automatic renewal to charge the next period. We will also give clear notice before an introductory or free period converts to its disclosed ongoing price. These are commitments for the future service and must be operational before activation.
Keep your contact and payment details current. If payment fails, we will notify you, explain any retry and provide a reasonable opportunity to resolve it. We may pause paid benefits after reasonable notice, but will not add an undisclosed penalty or silently move you to a more expensive plan. We will explain the status of your free account and saved work.
4. Cancelling and account access
You may turn off renewal using a clearly labelled online cancellation control in your account, with a contact route available if the control fails or you cannot sign in. Cancellation will not require a phone call, sales conversation or unnecessary steps when signup is available online. We will confirm cancellation and the date paid access ends.
Unless you choose immediate closure or a legal remedy requires an earlier end, ordinary cancellation stops the next renewal and paid benefits continue until the end of the period already paid for. The offer will disclose any actual minimum term; we do not impose one after purchase. Cancel before the displayed renewal time to avoid the next charge. If our cancellation system fails after a timely attempt, contact us so we can correct the resulting charge.
Ending membership does not by itself close your free account. We will explain which features remain and how to retrieve your information. Statutory rights and any refund owed remain available after cancellation.
5. Price and benefit changes
We will not increase the price for a period you have already paid for. A proposed renewal price increase requires at least 30 days' advance notice, or a longer period required by law or your offer, identifying the new price, date and a straightforward cancellation option. If that notice cannot be given before the next renewal, the increase will not apply to that renewal.
We may make reasonable changes to improve or maintain the service, respond to law or address security. We will explain a material adverse change to paid benefits in advance where practical. If it substantially reduces what you purchased during a paid period, you may cancel the affected membership and obtain a proportionate refund for its unused period; mandatory rights may give you a different or greater remedy. Urgent legal or security action may require shorter notice, but does not remove refund or other rights.
We will not silently remove a material paid benefit and require another payment to restore the original service. Where a change needs fresh agreement, we will obtain it rather than infer consent from inactivity.
6. Refunds, suspension and termination
Ordinary change-of-mind cancellation does not normally refund a correctly supplied, already used period unless the offer says otherwise. That rule never removes rights under the Australian Consumer Law or another mandatory law. A material service failure, misleading description, unauthorised charge or withdrawal of an agreed benefit may require correction, refund, cancellation or compensation.
Account restrictions follow the proportionate security and breach process in the Terms of Use. We will not automatically forfeit prepaid fees merely because an account is closed. If we discontinue a paid plan, we will give reasonable notice and refund the unused prepaid portion, subject to any greater legal remedy. We will explain any proposed deduction for a separately established lawful debt; we do not impose an automatic cancellation penalty.
Contact hello@fitfourby.com.au with your subscription or payment reference. Our complaint process, non-exclusive Western Australian jurisdiction and preservation of consumer rights are in the Terms of Use.
7. Versions and activation
The accepted version and checkout particulars will be retained with the transaction record. A future material amendment is subject to the notice, cancellation and fresh-acceptance protections above and in the Terms of Use. A price in planning material is not an activated offer.
The terms and purchase details that apply to a future membership will be shown before you subscribe. Nothing on this page authorises billing while membership remains unavailable.
